Terms of Service

1. Acceptance of these terms

These Terms of Service form a binding agreement between you and Capernaum LLC, a Georgia limited liability company, governing your use of the BiteLeague mobile application and website (together, the "Service"). By creating an account or using the Service, you agree to these terms. If you do not agree, do not use the Service.

Our Privacy Policy is part of these terms.

2. Who may use BiteLeague

You must be at least 13 years old to use BiteLeague. If you are under 18, you may use the Service only with the involvement of a parent or legal guardian who agrees to these terms on your behalf.

The Service is offered from the United States and is intended for users in the United States. You are responsible for complying with any laws that apply to you where you live.

3. Your account

You agree to provide accurate information when you register and to keep it current. You are responsible for everything that happens under your account and for keeping your credentials secure. Tell us promptly at [email protected] if you believe your account has been compromised.

One person, one account. Creating multiple accounts to earn additional points is a violation of these terms.

4. Dish claims and receipt verification

BiteLeague lets you claim dishes you have actually eaten by submitting a photo of the dish and a photo of the receipt showing your purchase. By submitting a claim, you represent that:

You personally purchased and consumed the dish
The receipt is genuine, unaltered, and yours
The photo is of the actual dish you received
You have not previously claimed the same purchase

Claims may be reviewed automatically, by the restaurant's verified owner, or by our administrators. We may approve, reject, or reverse any claim. Restaurant owners may contest a decision through our appeals process, and the outcome of an appeal may change a claim's status and any points awarded for it.

Submitting a forged, altered, borrowed, or duplicate receipt is fraud. It will result in loss of points and may result in permanent termination of your account.

5. Points and rewards

You may earn points for verified claims and other activity. Points are a promotional feature of the Service, and the following apply:

Points have no cash value and are not property, currency, or a stored-value instrument
Points cannot be purchased, sold, transferred, or exchanged for money
We may adjust, expire, or revoke points obtained through fraud, error, or violation of these terms
We may change the number of points awarded for any activity, and we may modify or discontinue the points program at any time
If your account is terminated, any unredeemed points are forfeited

Where points can be redeemed for a benefit at a participating restaurant, that benefit is provided by the restaurant, not by Capernaum LLC. We are not responsible for a restaurant's refusal to honor a reward, for the quality of any food or service, or for any dispute between you and a restaurant. Rewards are subject to the terms the participating restaurant sets.

6. Restaurant owner accounts

If you apply to manage a restaurant listing, you represent that you are an owner, officer, or authorized representative of that business and that every document you submit is genuine and accurately reflects your authority. Misrepresenting your association with a business is grounds for immediate termination and may expose you to legal liability.

Verified owners can review claims involving their restaurant, appeal decisions, customize their listing, and invite a limited number of additional owners. Owners may not submit dishes, photos, or votes for their own restaurant, and may not use their access to inflate their listing or suppress legitimate customer activity. We may revoke owner access at any time.

7. Your content

You keep ownership of the photos, descriptions, and other content you submit. By submitting content, you grant Capernaum LLC a non-exclusive, worldwide, royalty-free license to host, store, reproduce, display, adapt, and distribute that content for the purpose of operating, promoting, and improving the Service. This license continues for content that remains visible on restaurant listings after you delete your account.

You represent that you own or have the necessary rights to the content you submit, and that it does not infringe anyone else's rights.

Dish photos and other content you post to a public listing are visible to other users. Do not submit anything you want to keep private.

We may remove content that violates these terms, and restaurant owners may request removal of content involving their business.

8. Acceptable use

You agree not to:

Submit false, forged, altered, or duplicate receipts or claims
Create multiple accounts, or use bots or automated means to interact with the Service
Misrepresent your identity or your relationship to a business
Upload content that is unlawful, defamatory, harassing, hateful, obscene, or infringing
Post deliberately false reviews or ratings, whether to inflate or damage a business
Attempt to access accounts, data, or systems you are not authorized to access
Interfere with, overload, probe, or reverse engineer the Service
Scrape or bulk-collect data from the Service
Use the Service for any unlawful purpose

9. Third-party content and services

Restaurant names, addresses, hours, ratings, and reviews are supplied in part by Google and other third parties. We do not control this information and do not guarantee it is accurate, complete, or current — hours in particular change often. Verify with the restaurant directly before relying on it. Your use of Google-supplied content is also subject to Google's applicable terms.

Restaurants listed in the Service are independent businesses. Their appearance is not an endorsement, and we are not responsible for the food, service, safety, or conduct of any restaurant.

10. Availability and changes

We may modify, suspend, or discontinue any part of the Service at any time. We may also update these terms; when changes are material, we will update the date above and notify you in the app before they take effect. Continuing to use the Service after that means you accept the revised terms.

11. Suspension and termination

You may stop using the Service and delete your account at any time. We may suspend or terminate your account if you violate these terms, if we suspect fraud, or if we are required to by law. Sections that by their nature should survive termination — including content licenses, disclaimers, limitation of liability, indemnification, and governing law — survive.

12. Disclaimers

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE," WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED, SECURE, OR ERROR-FREE, OR THAT ANY INFORMATION IN IT IS ACCURATE.

We are not responsible for food safety, allergens, foodborne illness, or any aspect of your experience at a restaurant. Always confirm allergen and ingredient information directly with the restaurant.

13. Limitation of liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, CAPERNAUM LLC AND ITS MEMBERS, OFFICERS, AND AGENTS WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR FOR ANY LOSS OF PROFITS, DATA, GOODWILL, OR POINTS, ARISING OUT OF OR RELATING TO YOUR USE OF THE SERVICE.

OUR TOTAL LIABILITY FOR ANY CLAIM RELATING TO THE SERVICE WILL NOT EXCEED THE GREATER OF (A) THE AMOUNT YOU PAID US IN THE TWELVE MONTHS BEFORE THE CLAIM AROSE, OR (B) ONE HUNDRED U.S. DOLLARS ($100).

Some jurisdictions do not allow certain limitations, so parts of this section may not apply to you.

14. Indemnification

You agree to indemnify and hold harmless Capernaum LLC and its members, officers, and agents from any claim, demand, loss, or expense, including reasonable attorneys' fees, arising out of your use of the Service, your content, your violation of these terms, or your violation of any law or third-party right.

15. Governing law and disputes

These terms are governed by the laws of the State of Georgia, without regard to its conflict-of-laws rules. You and Capernaum LLC agree that any dispute arising out of or relating to these terms or the Service will be brought exclusively in the state or federal courts located in Georgia, and you consent to the personal jurisdiction of those courts.

If any provision of these terms is found unenforceable, the remaining provisions stay in effect. Our failure to enforce a provision is not a waiver of it.
